This Privacy Policy is governed by the Australian Privacy Principles under the Privacy Act 1988 (Cth) (hereafter ‘the Privacy Act’) and where we obtain Personal Information from a citizen of a member state of the European Union, the European Union General Data Protection Regulation (Regulation (EU) 2016/679) (the EU GDPR).

The Privacy Act contains 13 Australian Privacy Principles (APPs) which are rules about how the department may collect, use, disclose and store personal and sensitive information, and how you may access and correct records containing your personal or sensitive information. We are is committed to protecting your privacy in accordance with the APPs.

What is Personal Information and why do we collect it?

Personal Information is information or an opinion that may identify an individual. Examples of Personal Information we collect include: names, addresses, email addresses and phone numbers.

This Personal Information may be obtained in many ways including via our website, email lists, social media and other publicly available sources including cookies. Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.

We collect your Personal Information for the primary purpose of providing our information and services to you. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure.

When we collect Personal Information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.

We use Google AdSense for advertising on our website. Furthermore, Google, as a third party vendor, uses cookies to serve ads on our site. Use and Disclosure of Personal Information

  • we believe the use or disclosure is reasonably necessary for one or more enforcement related activities conducted by, or on behalf of, an enforcement body.

Integrity of Personal Information

We will take reasonable steps to ensure that the personal information:

  • is accurate, up-to-date and complete;
  • is accurate, up-to-date, complete and relevant when it is used or disclosed; and
  • is protected against loss, unauthorised access, use, modification or disclosure, and against other misuse.

All personal information held by the department is securely held physically or on IT systems.

Personal Information Breach

In the event of a breach of privacy , we employ practices to notify the relevant bodies under the Privacy Act and the EU GDPR within the required timeframes. Furthermore, we will notify you without undue delay, should it be found the breach places your rights and freedoms at risk.

Consent and Withdrawal of Consent

You understand and acknowledge that the consent you are to provide when submitting Personal Information to us is required in order for us to provide you with information or services. Failing to provide consent may result in failure to issue you with information or services.

Consent may be withdrawn by contacting us. After having received, reviewed and actioned your request, your withdrawal of consent will be recorded. We will act reasonably to action your request as soon as possible. However, we note that during the time between receiving your request to processing the withdrawal your Personal Information, you will not hold use liable for the use of your Personal Data during this processing time. Personal Information will be marked as ‘restricted’ between the time of processing your request to withdraw until the actual time of the withdrawal being actioned.

Right to be Forgotten

In addition to the withdrawal of your consent, you may also contact us to erase your Personal Information.  You may contact us to have your Personal Data erased and we will use our reasonable discretion to erase same if:

  • the Personal Information provided is no longer necessary in relation to the purpose of collection;
  • you have withdrawn your consent for us to hold your Personal Information;
  • the legal retention period for holding your Personal Information has expired;
  • you object to the use of your Personal Information; or
  • the processing of your Personal Information was not in accordance with the EU GDPR.

Access to your Personal Information

Under the Privacy Act you (as an individual) have rights to access and correct personal information that the department holds about you. If you request access to the personal information that insurance-endorsements.org holds about you, or you request a change to that personal information because it is incorrect, we will allow access or make the changes unless we consider that there is a sound reason under the Privacy Act or other relevant law to withhold the information or not make the changes. We aim to ensure that the personal information we hold is accurate, up-to-date, complete, relevant and not misleading. Please contact us (see details below) if you would like to seek access to, or correct, the personal information we hold about you.

Changes to this Privacy Policy

From time to time, it may be necessary for us to revise this Privacy Policy. Any changes will be in accordance with any applicable requirements under the Privacy Act and the Australian Privacy Principles. We may notify you about changes to this Privacy Policy by posting an updated version on this site.

Complaints

If you believe we breached the Australian Privacy Principles under the Privacy Act 1988 (Cth) or the EU GDPR, you may lodge a complaint as follows:

  • firstly, contact us through the Contact page and include the following in your complaint: your contact details; the section or provision of the Australian Privacy Principles or EU GDPR that you believe we breached; and, our practice or policy that you believe breaches the relevant Australian Privacy Principle or EU GDPR. You must allow us a reasonable time, about 30 days, to reply to your complaint;
  • secondly, you may complain to the Office of the Australian Information Commissioner if you are not satisfied with our response; or we do not respond to you within a reasonable time without sufficient explanation.
